Rahul Gandhi Defamation Case:
On Friday, the Supreme Court reprimanded Rahul Gandhi for his comments on Vinayak Damodar Savarkar and cautioned him against making similar statements in the future, warning of serious consequences. The court issued this warning while staying the Allahabad High Court's decision, which had refused to dismiss the summons issued against Gandhi by a trial court in Uttar Pradesh.
The Supreme Court, while hearing the defamation case, remarked, "They gave us freedom, and you treat them like this," referring to Savarkar’s contributions. The court further warned that it may take suo motu cognizance in the future.
This decision followed Rahul Gandhi's appeal against the Allahabad High Court’s ruling, which had declined to quash the summons in the defamation case. The case stems from Gandhi’s remarks on Savarkar made during his Bharat Jodo Yatra in Maharashtra's Akola district on November 17, 2022.
The bench also questioned senior advocate Abhishek Singhvi, representing Gandhi, about whether the Congress leader was aware that Mahatma Gandhi had used terms like "your faithful servant" in his communications with the British during colonial rule. The Supreme Court issued notices to the complainant, Nripendra Pandey, and the Uttar Pradesh government in response to Gandhi's petition seeking their replies.
The case originated from Gandhi's comments alleging that Savarkar had sought clemency from the British during his imprisonment. The Lucknow bench of the Allahabad High Court had earlier ruled that Gandhi could file a revision petition before the sessions court, making further intervention unnecessary at that stage. Gandhi had contested the trial court’s summons, claiming his remarks were part of a planned conspiracy to defame Savarkar.
