When you create an account — whether as a tourist or as a business partner — we collect:

• Full name
• Email address
• Password (stored in encrypted form; never readable by our team)
• Account type (tourist or business)

Business accounts may additionally provide: business name, location, phone number, WhatsApp number, operating hours, photos, and menu or service information.

1.2 Contact Form Data

When you submit a message through our contact form, we collect your name, email address, and the content of your message. This information is used solely to respond to your inquiry.

1.3 Usage and Analytics Data

We use analytics tools (including Google Analytics) to understand how visitors use the Site. This includes data such as:

• Pages visited and time spent on each page
• Device type, browser, and operating system
• Approximate geographic location (country or city level, derived from IP address)
• Traffic source (how you arrived at the Site)

This data is collected in aggregated and anonymized form where possible and is used to improve the platform's performance and user experience.

1.4 Cookies and Tracking Technologies

We use cookies and similar tracking technologies to operate the Site. A full description of the cookies we use is provided in Section 4 of this Policy.

1.5 Camera and Video Data

We use the personal data we collect for the following purposes:

• To create and manage your account and provide the services you have requested
• To respond to contact form inquiries and support requests
• To operate and improve the platform, including fixing technical issues and optimizing user experience
• To analyze usage patterns through aggregated analytics data
• To communicate with you about important updates, changes to our Terms or Privacy Policy, or your account status
• To comply with our legal obligations under Costa Rican law

We do not sell your personal data to third parties. We do not use your personal data for automated profiling or decision-making that produces legal or similarly significant effects.

Under Costa Rican data protection law, we process your personal data on the following legal bases:

• Consent: For analytics cookies and non-essential tracking technologies, we rely on your consent, which you can withdraw at any time.
• Contract performance: For account data and contact form data, processing is necessary to provide the services you have requested.
• Legitimate interests: For analytics and platform improvement purposes, we rely on our legitimate interest in maintaining and improving a functional digital platform, balanced against your privacy interests.
• Legal obligation: Where processing is required to comply with applicable law.

4.1 What Are Cookies?

Cookies are small text files stored on your device when you visit a website. They allow the Site to remember your preferences and understand how you interact with the platform.

4.2 Types of Cookies We Use

Essential cookies: Required for the Site to function correctly. These include session cookies that maintain your login state and security tokens. These cookies cannot be disabled without impairing core functionality.

Analytics cookies: Used to collect information about how visitors use the Site. We use Google Analytics, which may set cookies on your device and collect data about your browsing behavior in accordance with Google's own privacy policy. You can opt out of Google Analytics tracking by installing the Google Analytics Opt-out Browser Add-on.

Tracking/preference cookies: Used to remember your settings and personalize your experience (e.g., language, filters applied, last viewed content).

4.3 Managing Cookies

You can control and manage cookies through your browser settings. Most browsers allow you to refuse cookies, delete existing cookies, or be notified when a cookie is set. Please note that disabling certain cookies may affect the functionality of the Site.

Where legally required, we will present a cookie consent banner upon your first visit and will not activate non-essential cookies until you have given your consent.

5.1 What We Capture

LocalView operates a network of fixed-angle cameras installed at participating business locations. These cameras are positioned to capture the general atmosphere of each venue — such as a restaurant dining area, a beach terrace, or a surf zone — in publicly accessible areas. No audio is captured or transmitted at any time.

5.2 Live Streaming

Video from these cameras is streamed in real time to the LocalView platform, where it is visible to all users of the Site. By nature, individuals present in camera-equipped areas may appear in these public streams.

5.3 Buffer Recordings

To ensure service continuity when a camera feed is interrupted (for example, due to a connectivity issue), LocalView may retain a short-loop video buffer on its servers — typically a few minutes of footage. This buffer is used solely to display recent footage when the live feed is unavailable. It is not retained for any other purpose, is not analyzed, and is not shared with third parties. Buffer footage is automatically overwritten on a continuous cycle.

5.4 No Targeted Surveillance

LocalView does not use camera footage for facial recognition, behavioral profiling, targeted advertising, or any form of individual surveillance. Cameras are not directed at private areas, individual tables, or spaces where a reasonable expectation of privacy exists.

5.5 Signage

All participating businesses are required to post visible signage at the premises informing visitors of the presence of cameras. Individuals who do not wish to appear in any video stream should avoid camera-equipped areas.

5.6 Right to Request Removal

If you believe you have appeared in a video feed and wish to make a request regarding this, please contact us at hi@localview.live. We will review such requests in accordance with applicable law and our technical capabilities.

We do not sell, rent, or trade your personal data. We may share data with third parties only in the following limited circumstances:

• Service providers: We work with third-party service providers (such as hosting providers, analytics platforms, and email services) who process data on our behalf under confidentiality agreements. These providers are only authorized to use your data to provide the services contracted by LocalView.
• Google Analytics: Usage data is shared with Google in accordance with Google's privacy policy. You may opt out as described in Section 4.
• Legal requirements: We may disclose your information if required to do so by law or in response to valid legal process from competent authorities in Costa Rica.
• Business transfers: If LocalView is involved in a merger, acquisition, or sale of assets, your data may be transferred as part of that transaction. We will notify you before your data is transferred and becomes subject to a different privacy policy.

We retain your personal data only for as long as necessary to fulfill the purposes for which it was collected:

• Account data: Retained for the duration of your active account. Deleted within 90 days of account closure upon request.
• Contact form data: Retained for up to 12 months after the inquiry is resolved.
• Analytics data: Retained in aggregated form for up to 26 months, in line with Google Analytics default settings.
• Video buffer data: Continuously overwritten; no long-term retention.

You may request deletion of your personal data at any time (see Section 8).

Under Ley N° 8968 and its regulations, you have the following rights regarding your personal data:

• Right of access: You may request confirmation of whether we hold personal data about you and obtain a copy of that data.
• Right of rectification: You may request correction of inaccurate or incomplete data.
• Right of cancellation (deletion): You may request that we delete your personal data, subject to legal retention obligations.
• Right of opposition: You may object to the processing of your data where processing is based on our legitimate interests.
• Right to withdraw consent: Where processing is based on consent (e.g., analytics cookies), you may withdraw that consent at any time without affecting the lawfulness of prior processing.

To exercise any of these rights, please contact us at hi@localview.live. We will respond within the timeframe required by applicable law. You also have the right to lodge a complaint with the Agencia de Protección de Datos de los Habitantes (PRODHAB), Costa Rica's data protection authority.

We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, loss, destruction, or alteration. These include encrypted password storage, HTTPS-secured data transmission, and restricted internal access to personal data.

While we take these precautions seriously, no system can be guaranteed to be entirely secure. If you have reason to believe that your interaction with us is no longer secure, please notify us immediately at hi@localview.live.

LocalView is a general-audience platform and does not specifically target children under the age of 13. We do not knowingly collect personal data from children under 13. If we become aware that a child under 13 has provided us with personal information, we will delete that information promptly. If you believe a child has submitted data to our Site, please contact us at hi@localview.live.

We may update this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or platform features. When we make significant changes, we will post the updated policy on this page with a new effective date and, where appropriate, notify registered users by email.

We encourage you to review this policy periodically. Continued use of the Site after any changes constitutes your acceptance of the updated policy.
